1. Scope of Application
1.1 Scope of application of the GTC

These General Terms and Conditions (GTC) govern the business relationship between Katharina Balat, relationship counselor, and her clients. They apply to all services offered by Katharina Balat. These include in particular individual sessions, couple sessions, seminars, events and lectures, both online and on site.

1.2 Validity for future business relationships

These GTC apply to all future business relationships between Katharina Balat and her clients, even if they are not expressly referred to.

1.3 Changes and adjustments

Katharina Balat reserves the right to change the GTC at any time. Changes will be communicated to the client in good time and are considered accepted unless they are objected to within 14 days.

2. Conclusion of Contract
2.1 Conclusion of a contract

A contract between the client and Katharina Balat is concluded as soon as an appointment is booked via the online booking tool and confirmed through an automatic confirmation email. The booking constitutes a binding offer by the client. Upon receipt of the confirmation email, the contract is considered concluded – without the need for further written acceptance. If an appointment is agreed upon via email, telephone, or during a conversation and subsequently confirmed by Katharina Balat in writing (e.g. via email or calendar entry), this also constitutes a binding agreement. A framework agreement can be concluded for recurring sessions.

For seminars, events and talks, the booking is only valid if payment has been made in full in accordance with the agreed terms of payment. If payment is not made, the date shall not be considered binding.

2.2 Revocation

Consumers have a statutory right of revocation in accordance with § 355 BGB. The revocation must be made in writing within 14 days of the conclusion of the contract. The right of revocation does not apply to services that have already been provided before the expiry of the revocation period.

3. Services and Delivery
3.1 Type and scope of services

Katharina Balat offers comprehensive services in the areas of relationship counseling, sex therapy, couples therapy, body therapy and life coaching. These services include in particular

  • Individual sessions
  • Couples sessions
  • Seminars and events
  • Talks

The exact nature and scope of the service will be agreed individually with the client and confirmed in writing. Katharina Balat reserves the right to adapt, expand or change the services offered if necessary. Katharina Balat generally provides the services herself, but can also involve qualified cooperation partners.

3.2 Duration and frequency of sessions

The duration of a session is usually 90 minutes, unless otherwise agreed. The frequency of the sessions is determined individually and is based on the needs of the client and the recommendations of Katharina Balat.

For seminars, events and lectures, separate time specifications apply, which are specified in the respective announcements or event details.

3.3 Voluntary participation and responsibility of the client

Participation in all sessions, seminars or events is voluntary. Clients bear full responsibility for the implementation and application of the content conveyed during the sessions or events. It is recommended to clarify participation with a doctor or psychotherapist in advance if there are health or psychological concerns. There is no guarantee of specific results, as the success of the sessions depends largely on the active participation of the client him/herself.

3.4 Termination of counseling

Both the client and Katharina Balat can terminate the counseling or therapy at any time. In the event of termination by the client or Katharina Balat, sessions or events already performed will be billed; unused appointments will not be billed unless they fall under the cancellation policy.

Katharina Balat reserves the right to refuse bookings or registrations without giving reasons.

4. Duty of Confidentiality
4.1 General confidentiality

Katharina Balat undertakes to treat all information that becomes known in the course of counseling or therapy as strictly confidential. This includes in particular all personal data, conversation content, medical or psychological information and all other information related to counseling or therapy.

The duty of confidentiality also applies to third parties. All necessary measures are taken to protect the confidentiality of the client and it is ensured that this obligation is also complied with if cooperation partners are commissioned.

4.2 Exceptions (e.g. acute danger)

An exception to the duty of confidentiality exists in cases where there is an acute danger to the life, health or well-being of clients or third parties. In such cases, Katharina Balat is legally obliged to take appropriate measures to avert the danger and, if necessary, to inform the competent authorities or institutions. In such a case, the client will be informed in advance of the disclosure of the information, insofar as this is possible and reasonable.

4.3 Use of supervision

Katharina Balat reserves the right to discuss anonymized case studies in supervision or peer counseling in order to continuously improve the quality of counseling and therapy. No personal data or identifying information is passed on during supervision, so that the anonymity of the client is always guaranteed.

Clients can inform at any time if they do not agree to the anonymized use of their case studies. In such a case, it will be ensured that no information is passed on for supervision.

5. Prices and Terms of Payment
5.1 Fees and payment terms

The prices for the services offered are stated on the website or in the individual agreement with the client. All prices are net amounts, to which statutory taxes (e.g. VAT) may be added. Payments must be made within the period stated on the invoice without deductions. The deadline for payment is generally 14 days after receipt of the invoice, unless otherwise agreed.

5.2 Invoicing

Invoices are generally issued electronically by email. At the client’s request, an invoice can also be issued in paper form. The invoice will list all relevant information, including the respective service date, the scope of services provided and the amount of payment due. Katharina Balat reserves the right to charge a reminder fee in the event of repeated late payment by the client.

5.3 Assumption of costs

Costs cannot be assumed by statutory or private health insurance companies. The sessions, seminars and events offered must therefore be paid for in full by the client.

6. Cancellation and Rebooking Conditions
6.1 Deadlines for free cancellation and rebooking

Clients may cancel or reschedule appointments free of charge up to 48 hours before the scheduled time. The cancellation or rescheduling must be made in writing – by email, via the online booking tool, or through the individually agreed communication channels. If the cancellation or rescheduling is made after the 48-hour deadline has passed, the provisions of Section 6.2 shall apply.

6.2 Cancellation fee for cancellation at short notice

If appointments are canceled less than 48 hours before the agreed time, a cancellation fee in the amount of the full agreed fee shall be due. This also applies if the appointment is not kept without prior cancellation. An exception to this rule exists only if the cancellation is due to reasons for which Katharina Balat is responsible, such as illness of herself or unforeseeable emergencies.

This rule is necessary because appointments cancelled on short notice usually cannot be reassigned, and the time reserved for the client is lost.

6.3 Cancellation by the provider

Katharina Balat reserves the right to cancel or postpone appointments for good cause, especially in the event of unforeseen events such as illness or technical problems. In such cases, the client will be offered an alternative date in a timely manner. If no alternative date is available or desired, a full refund of payments already made for the canceled session will be made. In these cases, every effort will be made to minimize inconvenience to the client.

7. Liability
7.1 Limitation of liability

Katharina Balat is only liable for damages caused by intentional or grossly negligent behavior. Katharina Balat is only liable for damages caused by simple negligence if essential contractual obligations (cardinal obligations) are violated.

7.2 Personal responsibility of the client

The clients bear full responsibility for their actions inside and outside the sessions. Katharina Balat sees her services as support and orientation; the decision on their implementation lies solely with the client. Clients are advised that counseling and therapeutic services do not replace medical or psychiatric advice and that appropriate professional help should be sought if necessary.

7.3 Exclusion of the guarantee of success

Katharina Balat does not guarantee the success or specific results of the sessions, seminars, events or talks held. The effectiveness of the services offered is largely dependent on the active participation, openness and willingness to change of the client. A claim for reimbursement due to lack of results is excluded.

8. Rights of Use
8.1 Copyright provisions

All documents, materials and content on the website provided by Katharina Balat to the client are protected by copyright and remain the property of Katharina Balat. The client only receives a simple, non-transferable right of use for personal use. Any transfer to third parties or commercial use is prohibited without the express written consent of Katharina Balat.

8.2 Restrictions on the use of content

The content provided by Katharina Balat may only be used for personal use and within the scope of the agreed services. Any reproduction, distribution, making available to the public or other use of the content, whether in modified or unmodified form, requires the prior written consent of Katharina Balat.

Unauthorized framing, i.e. the display of content on this website within a separate frame or the circumvention of copyright mechanisms, constitutes improper use and is not permitted.

9. Data Protection
9.1 Handling of personal data

Katharina Balat undertakes to comply with the statutory provisions on data protection. All personal data collected in the course of working with clients, such as contact information, payment data and other relevant information, will be used exclusively for the performance of the agreed services, for invoicing and for quality assurance. The stored data will not be passed on to third parties without the express consent of the client, unless this is necessary for the fulfillment of contractual obligations or required by law.

9.2 Reference to privacy polacy

10. Severability Clause
10.1 Written form requirement

Amendments and additions to these General Terms and Conditions must be made in writing and require the mutual written confirmation of both parties.

10.2 Regulation in the event of ineffective provisions

Should a provision of these General Terms and Conditions be or become ineffective, this shall not affect the effectiveness of the remaining provisions. The parties undertake to replace the invalid provision with a valid provision that comes as close as possible to the purpose of the original provision.

10.3 Applicable law and place of jurisdiction

The law of the Federal Republic of Germany shall apply exclusively to the contract and its execution. Jurisdiction and place of fulfillment, as far as legally permissible, are at the registered office of Katharina Balat.
